ONLY 15 DAYS TO CHALLENGE LICENSE SUSPENSION!!

After a person is arrested for DWI and refusing a chemical test, he/she only has 15 days from the date of his/her arraignment to be scheduled for a Chemical Test Refusal Hearing with the New York State Department of Motor Vehicles (DMV).  Failure to appear at this hearing will result in automatic license suspension for one year, depending on the arrestee’s individual situation.

NEW YORK STATE DWI LAW

Pursuant to New York State law, a person can be convicted of an alcohol related offense if:
-The state can prove the accused was driving while their normal faculties were impaired OR
-The state can prove that the accused was operating a motor vehicle with a Blood or Breath Alcohol Concentration (BAC) of 0.08% or higher OR
-The state can prove that the accused was operating a motor vehicle while intoxicated.
